1. Acceptance of These Terms
By creating an account or using screenzor.com, the Screenzor Chrome extension, and related services (together, the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
Screenzor lets you record your screen, optionally upload recordings to generate shareable links, and collaborate with others through team workspaces. Some features process recordings locally on your device only; others require upload to our servers — see our Privacy Policy for details.
3. Eligibility and Accounts
You must be at least 13 years old to create an individual account. If you are under 18, you confirm you have permission from a parent or guardian. Use by students under a school's account is governed by our School/Institutional Terms Addendum, not this section.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Subscription Plans and Billing
Screenzor offers Free, Pro, and Pro+ plans as described on our pricing page. Paid plans are billed on a recurring basis (monthly or annual, as selected) via Payfast, and in the future may also be billed via Paystack. By subscribing, you authorize recurring charges to your chosen payment method until you cancel.
We may change our prices; if we do, we will give you at least 30 days' notice before the new price applies to your next billing cycle.
5. Cancellation and Refunds
You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of your current billing period. See our Refund and Cancellation Policy for details on refunds, including cooling-off rights available to South African and EU/UK consumers.
6. Acceptable Use
Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Violating it may result in suspension or termination of your account.
7. Your Content
You retain ownership of the recordings and other content you create using the Service ("Your Content"). By uploading or sharing Your Content through the Service, you grant Screenzor a limited, non-exclusive license to host, store, process, and display Your Content solely as necessary to provide the Service to you (e.g. generating a shareable link). We do not claim ownership of Your Content and will not use it for purposes beyond operating the Service without your separate consent.
You are solely responsible for ensuring you have the right to record and share any content you capture, including obtaining consent from any people appearing or speaking in your recordings where required by law.
8. Intellectual Property
Screenzor and its logos, software, and branding are owned by Donald Mzima or its licensors. Nothing in these Terms grants you rights to our intellectual property except the limited right to use the Service as intended.
9. Third-Party Services
The Service integrates with or is distributed via third parties (e.g. the Chrome Web Store, Supabase, Google Analytics/Ads, Payfast, Paystack). Your use of those third-party services is subject to their own terms, which we are not responsible for.
10. Data Processing
If you are using the Service as a business or educational institution and need a data processing agreement for your own GDPR, POPIA, or similar compliance purposes, our Data Processing Addendum forms part of these Terms and applies automatically to that processing. 11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Donald Mzima'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. NOTHING IN THESE TERMS LIMITS LIABILITY WHERE SUCH LIMITATION IS NOT PERMITTED BY APPLICABLE LAW (INCLUDING CERTAIN CONSUMER-PROTECTION RIGHTS IN THE EU, UK, AUSTRALIA, AND SOUTH AFRICA THAT CANNOT BE EXCLUDED BY CONTRACT).
13. Indemnification
You agree to indemnify and hold Donald Mzima harmless from claims arising out of your breach of these Terms or misuse of the Service, including claims related to Your Content.
14. Termination
We may suspend or terminate your account if you violate these Terms or the Acceptable Use Policy. You may stop using the Service and close your account at any time.
15. Governing Law and Disputes
These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles. If you are a consumer located in the EU, UK, Australia, or another jurisdiction with mandatory local consumer-protection laws, those laws may still apply and this section does not deprive you of protections you cannot waive by contract.
